What You Need to Know About Car Repossession in Georgia
How does car repossession work in Georgia?
Under Georgia law, if you are late on your car payments the creditor has the right to repossess the car, sell it and then sue you for the rest of the debt.
Once they sue you and get a deficiency judgment, they can then record a garnishment and levy your bank accounts and/or your pay check to collect on the debt.
Don't hide your car from your car company!
If unable to repossess your car without breaching the peace, the lender may then pursue judicial involvement to obtain its property and seek criminal charges against you.
Don’t play games though with the car creditor. You could end up with a criminal warrant issued against you!
Can I get my car back if it has been repossessed?
In most cases, yes. If your car was recently repossessed and has not been sold at auction (it usually takes 10 days for a sale to occur). Filing bankruptcy can stop the sale and force your car creditor to return it to you and allow you to restructure your payments in a Chapter 13 repayment plan.
How does bankruptcy stop repossession?
Filing for Chapter 13 bankruptcy can prevent your car creditor from repossessing your car.
How is that possible? Bankruptcy law is federal law. The moment your case is filed you are given legal protection from creditors. This includes an automatic freeze on repossession efforts. Bankruptcy provides consumers with options.
What happens if my car has already been picked up?
Once your car is repossessed, the car creditor typically sells at a car auction. Usually, the price they get for it at auction will not cover what you owe them under the contract. In Georgia, the car creditor will then turn around and sue you for the rest of the money owed on the contract. At this point you now owe for a car that you don’t even have.
How much does it cost to file my case?
Not as much as you think! To get your case filed and stop a sale or stop a repossession we have $0 down, $78 down, or $313 plans.
